Terms and Conditions of Use

The websites www.radaraddress.it and www.radaraddress.com are owned by RadarWave di Gianluca Sordiglioni (hereinafter "RadarAddress" or the "Service"). The terms RadarAddress, RadarWave and RadarWave di Gianluca Sordiglioni refer to the same entity and are interchangeable.

By using the Service, the user declares that they have read, understood and accepted these Terms and Conditions of Use.

Description of the service

RadarAddress is a SaaS (Software as a Service) platform for the quality of contact data. Depending on the active plan and the operations available, the Service includes: normalisation and verification of postal addresses in Italy and in the countries in service (listed on the Countries page), deduplication of contact lists with a consolidated record, generation and verification of the Italian tax code (codice fiscale), name enrichment, verification of email addresses, phone numbers and websites, preparation of lists for the Italian public opt-out register (Registro Pubblico delle Opposizioni), batch processing of files and API access.

The Service is intended primarily for professionals, businesses, public bodies and organisations that manage lists of customers, members or donors.

How the Service is delivered

The Service is delivered exclusively online, after registering an account, in three ways that draw on the same available operations: the web forms of your account, to process one record or a short list at a time; batch jobs, by uploading a whole file (CSV or spreadsheet) that is queued for processing and returned as a result file downloadable from your account; and the API, to integrate the operations into your own software with a personal token generated in your account.

RadarAddress provides processing services, not data. The reference archives used by the Service (street registers, postcodes, dictionaries and other databases) serve only to check the data supplied by the user: they are not sold, transferred, licensed or made available for consultation or export, in whole or in part. The Service does not supply lists of addresses, contact records, contact details or other databases. The results derive exclusively from the data supplied by the user: the Service corrects them, completes their form (for example postcode, coordinates, territorial codes) and compares them with one another, but does not add people, addresses or contact details that the user has not supplied.

It follows that the user may process only their own data, or data they are legitimately entitled to use, and that the processed data remain their exclusive property: RadarAddress does not keep them beyond the time needed to return the result, does not reuse them for its own purposes and does not cross-reference them with the data of other users.

Single operations (web forms and API) return the result in the response without storing its content. Uploaded files, the result files of batch jobs and deduplication results requested via the API are deleted automatically within 30 days, or earlier if the user deletes them from the My jobs page. Only usage and accounting data remain (number of operations, date, aggregate outcome), which contain no data from the processed records.

Registration and account

To access the features of the Service you must register, providing truthful and up-to-date information. Registration is completed by confirming the email address (double opt-in) and requires acceptance of the privacy policy.

The user must provide complete and accurate billing details, including a valid payment method, when purchasing a plan or a pack of operations.

The user may not share their account credentials or make the account available to third parties, and is responsible for keeping their login credentials confidential and for all activity carried out through their account.

RadarAddress reserves the right to suspend or close accounts in the event of a breach of these Terms.

Proper use of the account

Each RadarAddress account is personal to the user or to the organisation that holds it. It is expressly forbidden to:

  • register several accounts linked to the same organisation or natural person in order to multiply the free allowances or the limits of the subscribed plan;
  • circumvent the daily limits of the public demos with automated tools;
  • share credentials or API tokens with unauthorised third parties.

RadarAddress automatically detects abuse patterns and reserves the right, at its discretion, to contact the user for clarification, temporarily suspend the account pending checks, or close the account. No refund is due in cases of proven abuse. Users acting in good faith who believe they have been flagged by mistake may contact info@radaraddress.it to request a review of their case.

Plans, prepaid operations and payments

The contract is concluded upon acceptance of these Terms at registration. Any subsequent choice of a subscription plan or purchase of a pack supplements the financial terms of the relationship.

The Service works on prepaid operations, counted on a separate counter for each service (contact verification, deduplication, light operations), in two forms: the pack (a one-off purchase of a number of operations, with no expiry, cumulative, at the price of the size shown on the Pricing page) and the monthly subscription (a number of operations reassigned at each renewal, which does not accumulate and expires with the period). Operations are consumed in this order: free monthly allowance, subscription allocation, packs from the oldest. If the available operations do not cover an operation or a job, it is not started, unless auto top-up is active. Free registration includes a non-cumulative monthly allowance of operations for each counter.

There is no free trial period: plans and packs are activated upon payment. Payment is made in advance of use of the Service.

Paid plans are billed monthly and can be cancelled at any time. Payment is taken automatically from the payment method linked to the account. If a charge fails for any reason (expired payment method, insufficient funds, etc.), the system will retry the charge; if it still fails, RadarAddress may suspend the Service or end the subscription (the account remains registered, without a paid plan). The user remains liable in any case for the amounts accrued up to the time of suspension or termination.

In the event of a dispute or chargeback of a payment through the payment network, the pack purchased with the disputed payment is cancelled with immediate effect and auto top-up is disabled; if the disputed charge concerns a subscription, the subscription is ended immediately. If the dispute is resolved in favour of RadarAddress, the cancelled pack is restored. Repeated or unfounded disputes may lead to closure of the account under the section on abuse.

The operations in packs have no expiry and remain usable as long as the account is active. If an operation fails due to the Service or is cancelled by the user, the operations not carried out are automatically returned to the source they were taken from (pack or subscription allocation, the latter until the end of the period). With auto top-up active, when the operations are not enough to complete a job, the pack of the size chosen by the user is purchased and charged automatically, within any monthly spending caps set (per service and overall) and with notice by email; auto top-up can be disabled at any time from the account area.

In the event of prolonged inactivity of an account without an active subscription (no login for more than 3 years), RadarAddress reserves the right to close the account, after notice by email to the associated address.

Prices may be changed with prior notice to subscribed users.

Withdrawal and cancellation

Changing the subscription size. The user may change the size of a service subscription at any time from their account area, on the same subscription (a second one is not activated). Moving to a larger size takes effect immediately: the new allocation is available at once, less the operations already used in the current period (for example, moving to 50,000 operations after using 3,000 leaves 47,000 available), and the end of the period does not change. Financially, only the difference from the fee already paid for the current period is charged, calculated in proportion to the remaining time: no amount is refunded. Moving to a smaller size takes effect from the next renewal: nothing is due and nothing is refunded at the time of the request, and the current allocation remains usable until the end of the period.

The user may cancel the subscription at any time from their account area, and the Service will remain active until the end of the billing period already paid. No partial refunds are given for the remaining period. Pack operations are not refunded in money, but remain usable without expiry even after the subscription is cancelled.

The user may request deletion of their account and associated data by writing to info@radaraddress.it.

Operating limits and fair use

Each operation has a price in euro shown on the Pricing page, which forms an integral part of these Terms as regards the financial conditions. The price applied is that of the plan active at the time of use; without a subscription the full price applies.

The following technical limits also apply per job: files up to 100 MB and 1,000,000 rows (100,000 for deduplication); batch API requests up to 500 items per call; lists for the Italian public opt-out register up to 1,000,000 numbers (limit set by the register operator).

RadarAddress may apply further short-term operating limits (hourly or daily) to prevent abnormal use of computing resources and protect the quality of the Service for all users.

The limits stated may be updated under the mechanism set out in the Changes to the Terms section of this page.

Data uploaded by the user

The contact lists uploaded to the Service may contain personal data of third parties (names, addresses, phone numbers, email addresses, tax codes). With regard to such data the user remains the sole Data Controller; RadarAddress processes it as a Data Processor under Article 28 GDPR, solely for the processing requested, as described in the Privacy Policy and under the conditions of the Data Processing Agreement (DPA), which the user accepts together with these Terms.

The user warrants that they have the right to use and upload the data and content entered into the Service, including a valid legal basis for processing any personal data of third parties contained therein under Regulation (EU) 2016/679. The user shall indemnify and hold RadarAddress harmless from any claim, demand or action by third parties arising from the unlawful use of such content, including legal defence costs.

Restrictions on use

The content of the pages of the Service, including text, graphics, software, algorithms and data, is the property of RadarWave or of third parties and is protected by the applicable intellectual property laws (Berne Convention, Italian Law 633/1941 as amended).

The trademarks and distinctive signs published on the website are the property of RadarWave or of third parties. Access to the Service does not authorise the use of such trademarks without prior written permission.

It is forbidden to:

  • use the Service for illegal or unauthorised purposes
  • attempt to access other users' data or unauthorised sections of the platform
  • carry out automated scraping of the Service's data
  • use the Service to extract, copy or reconstruct the reference archives, in whole or in part, for example through systematic queries not related to the user's own data
  • interfere with the operation of the Service or of RadarWave's servers
  • resell or sublicense access to the Service to third parties without authorisation

Provision of the service and limitation of liability

The Service's processing is automated and relies on public and commercial reference sources (postal and street registers of the countries in service, statistical and cadastral data). Such sources may contain inaccuracies or may not reflect the latest changes to street names: this is why every result comes with an outcome and, where needed, notes flagging the cases to review.

The processing is intended as operational support and does not constitute professional advice. In particular RadarAddress does not guarantee: postal delivery to the normalised addresses (which depends on the carrier); the completeness and correctness of every single record processed; the detection of all duplicates in a contact list. The corrections proposed by the quality checks are never applied automatically: the decision remains with the user.

The Italian public opt-out register (Registro Pubblico delle Opposizioni) is an Italian institution and concerns Italian telephone numbers and postal addresses: anyone contacting them for commercial purposes must follow its procedure, even when operating from another EU Member State. For lists for the Italian public opt-out register, the Service is limited to preparing the list according to the specifications published by the register operator. RadarAddress does not consult the register on the user's behalf and guarantees neither acceptance of the list by the operator nor any fee bracket: consultation and the related legal obligations remain with the user, who must be a registered operator.

The user is solely responsible for decisions taken on the basis of the results provided by the Service. In no event shall RadarAddress be liable for direct or indirect damage to the user or to third parties caused by use of the Service, inaccuracies in the results, service interruptions or loss of data; liability remains within the mandatory limits of the law.

RadarAddress does not guarantee that the Service will always be available, continuous, free of errors or interruptions, and may temporarily suspend its operation for technical updates, maintenance or other necessary activities. Scheduled maintenance involving an interruption of more than 15 minutes will be announced by email or published on the website at least 24 hours in advance; shorter interruptions, emergency work and night-time maintenance require no notice. This shall not give rise to any compensation or partial refund, except for the automatic return of the operations not completed.

Result files remain available for download for 30 days from upload, after which they are deleted automatically: it is the user's responsibility to download them within that time.

Privacy and data processing

The processing of users' personal data is governed by the Privacy Policy, which forms an integral part of these Terms. It describes, among other things, the Data Controller, the purposes, the legal bases, the retention periods, the rights of data subjects and the processing of third-party data contained in uploaded files.

Links to external websites

The Service may contain links to third-party websites. RadarAddress has no control over such websites and accepts no responsibility for their content, privacy policies or operating practices. External websites are visited entirely at the user's own risk.

Changes to the Terms

RadarAddress reserves the right to change these Terms at any time. Changes will be communicated to registered users by email to the address linked to the account and published on this page with the date of the update. Changes take effect 30 (thirty) days after notification. Users who do not wish to accept the changes may delete their account before they take effect. After that period, the changes are deemed accepted.

Governing law and jurisdiction

These Terms are governed by Italian law. For any dispute connected with the Service, unless otherwise provided by consumer protection law, the courts of Milan, Italy shall have jurisdiction.

Language

These Terms are written in Italian. Versions in other languages are provided for convenience only: in the event of any discrepancy, the Italian version prevails.

Express acceptance of clauses

Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the user declares that they have read these Terms clearly and in full and that they specifically and expressly know and accept the content of the clauses in the following sections: "Proper use of the account", "Plans, prepaid operations and payments", "Operating limits and fair use", "Data uploaded by the user", "Restrictions on use", "Provision of the service and limitation of liability", "Changes to the Terms", "Governing law and jurisdiction", "Language".
